This isn’t the first health crisis faced by the 81 year old Supreme Court Justice; she managed to survive two bouts of cancer in the 1990s. Her recent surgery has prompted talk among Democrats that she should retire while President Obama is still in the White House to make it more likely that a replacement for Ginsburg, who represents the more liberal wing of the Supreme Court, will have like-minded views. However, following the Republican victory in the Senate, requests from liberals that she retire may be too little too late.

Meanwhile, Justice Ginsburg has been steadfast in her determination remain at the Supreme Court. As she said with characteristic frankness at an AP interview in July, “So who do you think could be nominated that could get through the Senate that you would rather see on the Court than me?”
