Although everything’s for sale on Amazon, the online retailing giant couldn’t sell a judge on throwing out the Durst Organization’s $25 million fraud claim against it.
Manhattan Supreme Court Justice Shirley Werner Kornreich just allowed Durst to press its claim that Amazon fraudulently violated a 2013 letter of intent regarding a potential lease for 310, 000 square feet at 1133 Sixth Ave.
The letter of intent did not bind the parties to sign a lease. It did, however, require Douglas Durst’s and Jeff Bezos’ companies to maintain exclusive negotiations with each other until a decision was made about the matter.

Amazon, however, stunned Durst by inking a deal with Vornado at 7 W. 34th St. during the same period.
