The legal battle between two major Israeli firms, Orca Security an Israeli cybersecurity startup that specializes in cloud services security and Wiz an Israeli unicorn that offers an API security platform, alleging copyright infringement, is set to move forward. Calaclist reported that a Delaware court rejected Wiz’s request to dismiss the lawsuit which seeks to block Wiz from signing any new businesses with technologies that Orca Security alleges Wiz infringed on its patents and seeks unspecified monetary damages.

The court also assigned “expert external consultants” to review the companies’ respective designs in order to determine if there is basis to Orca Security’s allegations. Meanwhile, Orca has complained that Wiz is not turning over all of the documentation the company is required to provide as part of the civil suit.

The lawsuit was filed in the District Court of Delaware in the U.S. and charges that Wiz “has built its business on a simple business plan: copy Orca,” and that the firm “knowingly copied Orca’s patents, its prosecution strategy, and even its prosecuting attorney.”

Wiz was founded in March 2020 by the team that led Microsoft’s Cloud Security Group and built the security stack in Azure. CEO Assaf Rappaport, CTO Ami Luttwak, VP Product Yinon Costica, and VP R&D Roy Reznik, have worked together for more than 15 years and previously founded Adallom (acquired by Microsoft for $320 million), which is now the #1 Cloud Access Security Broker in the market.

Wiz became a super unicorn and the world’s biggest cybersecurity startup when it hit a $10 billion valuation in January. The valuation came with a $300 million raise in a Series D funding round led by Lightspeed Venture Partners and existing investors Greenoaks Capital Partners and Index Ventures. Wiz also became the fastest SaaS company to achieve a $10 billion valuation.

Founded in 2019, Orca Security offers a cloud security innovation. The company provides cloud-wide, workload-deep security and compliance for AWS, Azure, and GCP. Orca boasts that it treats a client’s cloud as an, “interconnected web of assets, prioritizing risk based on the severity of the underlying security issue combined with environmental context, including its accessibility and potential damage to the business.” This does away with thousands of meaningless security alerts to provide just the critical few that matter, along with their precise path to remediation.
