Manuela Herzer, the former girlfriend and live-in companion of media billionaire Sumner Redstone is seeking a new trial to show he’s mentally not competent to make health care and legal decisions and that he is under the influence of his daughter Shari Redstone.
Redstone, 93, won a summary judgement in a previous suit by Herzer who last October was outed from Redstone’s mansion, and cut out of his will.

Los Angeles judge dismissed her lawsuit last month ended Herzer’s trial after one day of testimony. Redstone’s videotaped deposition made it clear he didn’t want Herzer in his life anymore.
Herzer’s lawyer Pierce O’Donnell of Greenberg, Glusker, said in a statement Monday: “The evidence at the new trial will prove in detail how it came to pass that Redstone has been transformed into a fragile shell of a once powerful media titan whose video testimony showed him mechanically condemning his beloved and loyal friend Herzer and embracing his long-estranged and thoroughly detested daughter Shari as his health-care agent.”
The lawyer added the saga reads like Shakespeare: “Mentally incapacitated Redstone is a demented Lear. Ailing and easily fooled, King Lear, unable to discern false flattery from the truth, is duped into surrendering his power, land, and fortune to his two conniving daughters who ruthlessly implement their scheme to eliminate all opposition.
“At the end of a new trial, we will urge Judge Cowan to grant the petition and prevent what happened to Lear where ‘machinations, hollowness, treachery, and all ruinous disorders, follow us disquietly to our graves’.”
Meanwhile, Redstone had a battle for control of his $40-billion media empire. He has moved to seize control of Viacom and CBS from long-time friends and colleagues including Viacom CEO Philippe Dauman.
Redstone has also made changes in the board to make it difficult for Viacom and Dauman to consummate its plan to sell a 49% stake in Paramount Picture.
Dauman sued Redstone in Massachusetts trying to get Redstone moves annulled.
