Viacom CEO calls for ‘immediate medical examination’ of Sumner Redstone

Lawyers for wyers for Viacom Chief Executive Philippe Dauman as well as Viacom board member George Abrams, assert in new court papers that ailing Sumner Redstone should submit to an “immediate medical evaluation” by a neutral doctor to determine the media mogul’s mental capacity.

The two executives filed a lawsuit two weeks ago against their removal as trustees of Redstone’s trust. The trust will control Redstone’s family investment vehicle, National Amusements Inc. which includes Viacom and CBS after he dies or is incapacitated.

The first hearing in the matter scheduled for Tuesday in a Massachusetts court.

In the filing submitted Monday morning, Dauman and Abrams notes that Redstone was hospitalized in the last few weeks.

Court documents signed by lawyer Joseph L. Bierwirth Jr. say “In the absence of prompt proceedings, there is grave risk that Sumner Redstone will not be available to provide any evidence in this case. He is a 93-year-old man suffering from overwhelming physical ailments, including an inability to speak, stand, walk, eat, write or read. He suffers from a progressive neurological disease characterized by dementia, ” the filing reads.

But representatives for Redstone said that the media mogul was recently examined by a geriatric psychiatrist and finded that he had the mental capacity to remove Dauman and Abrams from the trust.

last week in their court filing, Redstone’s lawyers decried the lawsuit as “an acutely self-interested legal strategy that they began plotting months earlier to secure their tenuous positions with Viacom.”

While the company spokesman said “Sumner Redstone would never have summarily dismissed Philippe Dauman and George Abrams, his trusted friends and advisors for decades.”
