Harvey Weinstein To Try Another Appeal

But no matter the outcome he faces many rape charges in other places too.

Harvey Weinstein thinks that he still has a chance of getting out of jail. He now intends to launch another appeal of his previous convictions. According to a report in The Sun, Weinstein Spokesman Juda Engelmayer said: “We expect there to be an appeal.”

But there is now word on what would be the basis of an appeal. One cannot simply ask a judge to overturn a conviction or reduce a criminal sentence. There usually needs to be some sort of judicial error or misconduct in some form involved. And even if Harvey Weinstein should succeed and be released from jail in New York he will immediately be turned over to California authorities for trial there on additional charges.

The former Hollywood mogul was convicted in New York State on February 24, 2020 on 2 of five counts charged — criminal sexual assault in the first degree and one count of rape in the third degree. On March 11, 2020 he was sentenced to 23 years in prison. And even in jail Weinstein can still be charged and tried in another jurisdiction.

In October six new sexual assault and rape charges were brought against him in Los Angeles, bringing the total number of charges that he faces there to 11.

The Los Angeles County District Attorney’s Office leveled the six additional charges against Weinstein which include three counts of forcible rape and three counts of forcible oral copulation. If convicted in Los Angeles, Harvey Weinstein could be sent to jail there to serve whatever sentence immediately after he gets out of jail in New York. That is if he ever does get out of jail.

No matter what, however, Harvey Weisntein has lost everything: his money, his empire, his family and his power. He will never get those back.
